THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE T.AMARNATH GOUD WRI T PETI TI ON NO.8915 of 2018 ORDER: (per SK,J) The petitioner assails the action of the respondents in not considering her request to waive the loan sanctioned to her by the State Bank of India pursuant to the scheme introduced by the Central Government and the National Bank for Agriculture and Rural Development (NABARD) in relation to Emu bird farming.

By interim order dated 22.03.2018, this Court directed that no coercive steps should be taken against the petitioner. Ms.V.Uma Devi, learned counsel representing NABARD, would inform this Court that the Department of Animal Husbandry, Dairying and Fisheries, Ministry of Agriculture & Farmers Welfare, Government of India, issued Speaking Order dated 16.12.2015 conveying the decision of the Department of Financial Services, Ministry of Expenditure, Government of India, that all concerned lending banks should act in accordance with the letter dated 09.09.2015, whereby it was left open to the commercial banks to restructure the loans and extend the repayment period of such loans to any category of borrowers who have come under stress. We are further informed by Mr.

Mangena Sree Rama Rao, learned counsel for the petitioner, that the State Level Bankers Committee in its meeting held on 28.06.2018 decided to extend certain benefits to Emu bird farmers who had availed loans. A copy of the said communication along with the promised benefits in terms thereof is placed on record. Mr. M.

representation in the context of the aforestated developments, the bank would consider her request in relation to her loan account as per the norms.

The writ petition is accordingly disposed of leaving it open to the petitioner to make a suitable representation to the State Bank of India within a period of two weeks from the date of receipt of a copy of this order. The State Bank of India shall thereupon take a decision in the matter within four weeks from the date of receipt of such representation. Pending such exercise, no coercive steps shall be taken against the petitioner in relation to the subject loan account.
