THE HON'BLE SRI JUSTICE A.ABHISHEK REDDY CIVIL REVISION PETITION No.912 of 2021 ORDER:

This Civil Revision Petition under Article 227 of the Constitution of India is filed against the docket order dated 12.10.2020, passed by the learned III Additional Sessions Judge, Gadwal, in I.A.No.141 of 2020 in O.S.No.5 of 2020.

Learned counsel for the petitioners states that the petitioners/plaintiffs filed the above I.A under Order XXXIX Rule 1(a) C.P.C. r/w Section 151 C.P.C. to issue an ad-interim injunction restraining the respondents from alienating the suit schedule property or any part thereof, but, the Court below is not disposing of the said I.A, and therefore, he prays to issue a direction to the Court below to dispose of the said I.A. as expeditiously as possible, in view of the urgency pleaded therein. As the petitioners merely seek a direction to the trial Court to dispose of the pending I.A., this Court deems it unnecessary to put the respondents on notice or afford them an opportunity of hearing and go into the merits of the case.

In the circumstances, the Civil Revision Petition is disposed of directing the learned III Additional Sessions Judge, Gadwal, to dispose of I.A.No.141 of 2020 in O.S.No.5 of 2020, on merits and in accordance with law, as expeditiously as possible, preferably within a period of three weeks from the date of receipt of a copy of this order, duly putting all the parties on notice.

Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
