O R D E R

This writ petition is filed seeking Writ of Mandamus declaring the auction notification dated 13.01.2015 issued by the 1st respondent calling for tenders for grant of license rights for supplying of sanitation workers and other workers for a period of 01.02.2015 to 31.01.2016, as illegal and arbitrary and consequently to direct the respondents to continue the members of the petitioner society under the new agency by paying minimum wages.

Heard the learned counsel for the petitioner. Learned Standing counsel for the 1st respondent submits that out of 50 workers, 25 workers have been continued in the new agency and the balance workers cannot be accommodated as the new workers are already on their rolls.

In the instant case, petitioner has no legal right in asking to continue its workers in the new agency. However, the new agency has taken 25 workers and no mandamus can be issued asking to continue the balance workers in the new agency. No rule or provision of law is shown for their continuance.

Recording the submission of the learned Standing Counsel for the 1st respondent, this writ petition is disposed of. The miscellaneous petitions if any in this writ petition shall stand disposed of. There shall be no order as to costs.
