HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.13059 OF 2016 ORDER:
The petitioner seeks a direction to the respondents to consider his representation dated 22.02.2016.
It is the case of the petitioner that he came to be allotted Shop No.1 at Thugundram Grampanchayat, Gangadhar Nellore Mandal, Chittoor District for one year. Now the respondent authorities are proposing to issue a notice dated 29.02.2016 directing the respective owners to vacate their premises and handover the keys to the Panchayat, as it is proposed by the Panchayat to allot the shops in public auction to the highest bidder. The petitioner submits that he could not recover the investment which has been made in one year period, for which the petitioner was earlier granted lease. Hence, he seeks a direction to the respondents to consider his representation to continue in the premises by exempting him from the proposed auction.
This writ petition is resisted by learned standing counsel for the Grampanchayat and submitted that the Grampanchayat is implementing the orders of the Collector dated 31.03.2016, wherein to enhance the revenues of the Panchayat, the Collector had directed auction to be conducted for a period of three years and the properties to be leased out for a period of three years through auction process.
Having considered the rival submissions, there being no vested right to the petitioner, the method adopted by the respondents for leasing out the properties in public auction cannot be found fault. Admittedly, the petitioner has right for one year, which period already expired. In that view of the matter, the prayer of the petitioner to direct the respondents to consider his representation cannot be acceded to as there being no right for the petitioner and there being no obligation to the respondent authorities to consider such application. In these circumstances, liberty is given to the petitioner to participate in the auction.
With the above observation, the writ petition is dismissed. There shall be no order as to costs.
Miscellaneous petitions, if any pending in this writ petition shall stand closed.
