HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 8961 of 2017 ORDER:

The Writ Petition is filed complaining that respondent No.3 is making construction without obtaining permission, as is evident from the letter dated 01.12.2016 furnished by respondent - Corporation in response to RTI application made by the petitioner. Bringing this aspect to the knowledge of respondent - Corporation that respondent No.3 is making construction without there being permission, the petitioner had made complaints on 21.10.2016 and 06.03.2017. Despite which, no action has been taken by respondent - Corporation. Hence the Writ Petition.

Sri P.Kesava Rao, learned Standing Counsel for respondent - Corporation, on instructions, submits that, respondent No.3 had approached VI Junior Civil Judge, City Civil Court, Hyderabad, by filing O.S.No.498 of 2017 and had obtained an injunction order. He would further submit that necessary steps are being taken to vacate the injunction order and, thereafter, necessary action would be taken against respondent No.3 in accordance with law. In the facts and circumstances of the case, Writ Petition is disposed of giving liberty to the petitioner to get impleaded in the suit, and bring to the notice of the Civil

Court of the unauthorized constructions made by respondent No.3. It is also made clear that the disposal of the writ petition, and also pendency of the civil suit, does not preclude the respondent - Corporation from issuing notice, as required under the Greater Hyderabad Municipal Corporation Act, 1955, and put the process in action. Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
