THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION No.32351 of 2011 ORDER:
This writ petition is filed, under Article 226 of the Constitution of India, against the Commissioner of Endowments, State of Telangana, impugning the action of the said respondent in not permitting the alienation of the land belonging to Sri Ranganayaka Swamy Temple, Mogiligidda village of Farooqnagar Mandal of Mahaboobnagar District, admeasuring Ac.2.32 guntas situate in Sy.No.42 of Vityala Village of Farooqnagar mandal, by public auction.
At the hearing, learned counsel for the petitioner would submit that for the reasons stated in the affidavit filed in support of the writ petition, the learned Commissioner ought to have considered the application, dated 18.10.2011, of the petitioner and ought to have passed an order and that the grievance of the writ petitioner would be redressed if a direction is given to the respondent to pass appropriate orders on the said application of the petitioner. Learned Government Pleader for Endowments endorses the said submission of the learned counsel for the writ petitioner. Recording the submissions, the Writ Petition is disposed of directing the respondent to pass appropriate orders on the application, dated 18.10.
2011, of the petitioner in strict accordance with the procedure established by law as expeditiously as possible and preferably within two (2) months from the date of receipt of a copy of this order. For abundant caution, the petitioner is given liberty to supply a copy of the application, dated 18.10.2011, to the Commissioner, under proper acknowledgment, for consideration.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
