THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO W.P.No.5289 OF 2017 O R D E R :

This Writ Petition is filed assailing a notice dt.30.01.2017 issued by the 3rd respondent under Section 452(1) of Greater Hyderabad Municipal Corporation Act, 1955 asking the petitioner to show cause why certain constructions made by the petitioner should not be removed treating it as unauthorized construction.

Counsel for the petitioner seeks to contend that though the petitioner had already given explanation thereto on 06.02.2017, before considering the same, the respondent 2 and 3 may demolish the structures erected by the petitioner. 3.

Sri Chatla Madhu, Standing Counsel for GHMC states that without considering the petitioner's explanation dt.06.02.2017 to the show cause notice dt.30.01.2017, no demolition of the structures erected by the petitioner would be done.

In view of the said submission, the Writ Petition is disposed of directing the respondents 2 and 3 to consider petitioner's explanation dt.06.02.2017 to the show cause notice dt.30.01.2017 and communicate their decision

thereon to the petitioner and only thereafter take any further action in the matter. There shall be no order as to costs. 5.

Consequently, miscellaneous petitions pending if any, shall stand closed.
