THE HOI{OURABLE SMT. JuSTICE T. MADHAVI DEVI CONTEMPT CASE No.1O64 OF 20.23 ORDER:

The Contempt Case is filed seeking punishment to the respondents under Section l0 to 12 of Conternpt of Court Act, for violation and wilful disobedience in implementation of the interim order of this Court dated 2O.O7.2O22 passed, ln I.A.No. I of 2022 in W.P.No.29865 of 2022 and to pass such other order or orders.

2. This Court, vide order dated 20.07.2022 passed ln W.P.No.29865 of 2022, granted interim suspension of the recovery proceedings dated 12.07.2021 and the said order was extended from time to time. As the respondents issued letter dated O3.03.2023 vrolating the order of this Court, the present Contempt Case has been frled.

This Court while admitting the contempt case, issued ,t form-I notice to the respondents on OL.12,2023 and accordingly, the contemnors are present before this Court today.

4. karned counsel appearing for contemnors submitted that the internal letter dated 03.03.2023 was issued by respondent No.l for recovery since he did not have knowledge

about the interim order dated 2O.O7.2O22 granted by this Court in W.P.No.29865 of 2022. It is further submitted that as soon as the respondents came to know about the said order, they kept the letter dated 03.O3.2023 in abeyance and also assured that no recovery would be made till the disposal of the main writ Petition'

S. parned counsel for the petitioner also confirmed that no recovery was made from the petitioner's account till date.

6. In view of the submissions of both the parties, particularly the undertaking given by the contemnors that no recovery would be made till the disposal of the writ petition, the Contempt Case is closed. There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
