THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.498 OF 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The order of resumption, dated 18.12.2015, passed by the Tahsildar, Hayathnagar Mandal, Ranga Reddy District, the 4th respondent, on the ground of violation of conditions of assignment, is questioned in this Writ Petition.

It cannot be disputed that the said order is appealable under the provisions of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977. Since the order is passed only on 18.12.2015, the petitioner is at liberty to approach the appellate authority. The Writ Petition cannot be entertained in view of the said efficacious alternative remedy available to the petitioner. The Writ Petition is dismissed giving liberty to the petitioner to approach the appellate authority to avail the efficacious alterative remedy available to him. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
