HON'BLE DR. JUSTICE B. SIVA SANKARA RAO I.A.Nos.1 & 2 of 2018 IN/AND Crl.A.No.31 of 2013 JUDGMENT:

The defacto complainant along with her sister and brotherin-law with a kid present stating that her marriage performed with another person by name Jairam and got a child in their wedlock and this case is coming in the way for her future and her husband also finding fault with and it is under certain set of circumstances the report was given and the accused already convicted and in the appeal she wants to compound the offence though noncompoundable want to purchase the peace and particularly in the betterment of marital life with her husband and by taking into consideration of these facts and the accused and his parents came and he expressed remorse and changed in life after registration of the crime and the terms of the compromise was also appended. In view of the compromise, the offences are compounded and the accused is acquitted and the bail bonds of the accused, if any, shall stand cancelled.

Accordingly and in the result, both the I.A.Nos.1 & 2 of 2018 and the Criminal Appeal are allowed by setting aside the sentence of imprisonment passed by the lower Court dated 16.01.2013 in S.C.No.10 of 2012 in view of the above compromise. However, the accused is not entitled to the refund of the fine amount paid to the State.
