THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition Nos.16514 and 16792 of 2011 COMMON ORDER:
The relief sought for, in these two writ petitions, is to declare the action of the respondents in terminating the respective agreements entered into with the petitioners by letters dated 16.05.2011, and in calling for the fresh tenders, as arbitrary and illegal and to set aside the same. A consequential direction is sought to the respondents to continue the contract, by way of hiring the vehicles, till the period of completion of the agreements.
It is asserted, in the affidavits filed in support of the respective writ petitions, that agreements dated 30.07.2009 were entered into with the petitioners, for providing the vehicles mentioned therein, from 01.05.2009 to 31.03.2012; and the said agreements were pre-maturely terminated by letters dated 16.05.2011. The case of the petitioners is that, since the period of contract was valid till 30.03.2012, termination of the agreements prior thereto is illegal.
Interim orders were passed, in WPMP.No.19817 of 2011 in W.P.No.16514 of 2011 dated 16.06.2011, and in WPMP.No.20166 of 2011 in W.P.No.16792 of 2011 dated 17.06.2011, directing the respondents to continue hiring the respective vehicles of the petitioners. Pursuant to the said interim orders, the petitioners' vehicles must have been engaged till the completion of the contract period on 31.03.2012. As the relief sought for in the writ petitions is only to continue to hire the respective vehicles of the petitioners till the end of the contract period on 31.03.2012, which expired nearly 6 years ago, it is evident that the cause in the writ petitions does not survive necessitating any further adjudication by this Court.
Both the Writ Petitions are, accordingly, dismissed as infructuous. Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs. _________________________________ (RAMESH RANGANATHAN, ACJ) 23rd February, 2018 JSU
