HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.22238 OF 2007 ORDER:

This writ petition is filed seeking to issue a writ of Certiorari calling for the records relating to and connected with I.D.No.56 of 2004 on the file of the 1st respondent-Labour Court; to quash the award dated 21.9.2006 passed therein only to the extent of denial of 50% of back wages to the petitioner; and consequently, to direct the 2nd respondent to make payment of 50% of back wages from the date of removal till reinstatement of the petitioner.

Heard Sri P. Venkateswar Rao, learned Counsel for the petitioner and Sri N. Vasudeva Reddy, learned Standing Counsel for the 2nd respondent-Corporation.

It is the case of the petitioner that he was appointed as a conductor on 6.6.1983 and while he was discharging his duties as such, in the year 2002, the checking officials conducted check and alleged that the petitioner committed cash and ticket irregularities. The respondent-Corporation after conducting enquiry imposed major punishment of removal. Against the same, the petitioner filed I.D.No.56 of 2004 before the Labour Court. The Labour Court allowed the I.D. partly setting aside the order of removal and directing the respondent-Corporation

to reinstate the petitioner into service with continuity of service and with 50% back wages. Aggrieved by denial of 50% back wages, the petitioner filed this writ petition. 4.

The learned Standing Counsel for the respondentCorporation contended that the respondent-Corporation also challenged the award passed in the above I.D.No.56 of 2004 by filing W.P.No.18491 of 2007 and this Court vide order dated 26.9.2018 dismissed the said writ petition.

This Court has considered the submissions made by the parties and the order passed in W.P.No.18491 of 2007, dated 26.9.2018. The petitioner could not point out any illegality or irregularity in the award impugned. Moreover, this Court confirmed the award impugned in W.P.No.18491 of 2007. Therefore, this Court cannot grant any relief in this writ petition. 6.

Accordingly, the Writ Petition is dismissed. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
