THE IIONOURABLE JUSTICE G. SRI DE\/I CRIMINAL PETITION No.2765 of 2019 ORDER:

The petitioner/sole accused filed the present application under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with Crime No.37 of 2019 of Chinthalapalem Police Station, Suryapet District, registered for the offences punishable under Sections 353, 341, 504 and 506 IPC.

Heard learned counsel for the petitioner and learned Public Prosecutor appearing for the respondent-State. Perused the material on record.

It is submitted by the leamed counsel for the petitioner that the petitioner is innocent, he has been falsely implicated in the present case and he has not committed anv offence. He further submitted that the de facto complainant, being the same community member, developed personal grudge against the petitioner and falsely implicated him in the present case by leveling false and frivolous t t allegations against him. He further submitted that no offence under Sections 341 and 353 IPC is made out against the petitioner. It is further submitted that most part of the investigation in the aforesaid case is completed^ hence, the question of tampering with the witnesses does not arise and the petitioner undertakes to abide any of the conditions imposed by the Court. Thus, he prayed to grant anticipatory bail to the petitioner.

\ Having regard to the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner on certain terms and conditions.

Accordingly, the criminal petition is allowed and the petitioner is directed to surrender before the Station House Officer, Chinthalapalem Police Station, Suryapet District, within a period of fifteen days from today and on such surrender, the petitioner shall be released on bail on his executing a personal bond for Rs.5,000/- (Rupees five thousand only) with two sureties for a like sum each to the satisfaction of the said Station House Officer. Further, the petitioner shall appear before the said Station House Officer on every Wednesday and Sunday between 10.00 a.m. and 11.00 a.m. for a period of four weeks or till filing of the charge sheet, whichever is earlier.
