HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.8716 of 2018 ORDER:

Heard the learned counsel for the petitioners, the learned Government Pleader for Fisheries (A.P.) for the respondents 1 to 3, the learned Government Pleader for Revenue (A.P.) for respondent No.4, the learned Government Pleader for Home (A.P.) for respondent No.5 before notice to the unofficial respondent No.6 and perused the prayer in the Writ Petition with supporting affidavit and other material on record.

It is the submission of the learned Government Pleader that after obtaining permission from the District Level Committee as per G.O.Ms.Nos.7 & 15, the unofficial respondent No.6 started digging of the fish pond in the land and from the objections raised by the local persons, he approached the High Court in W.P.No.21938 of 2017 where the High Court passed orders on 07.07.2017 disposing of the Writ Petition directing the respondents not to interfere with the conversion so long as the petitioner confines to the conditions mentioned in the Provisional Registration Certificate and if any violation is there, it is open to the respondents to take appropriate steps in accordance with law.

Having regard to the above, there is nothing to keep the Writ Petition pending much less interfering with the provisional permission, but for to say the respondents shall receive written objections of the petitioners being filed afresh within a period of one (1) week from the date of receipt of a copy of this order and consider the same and pass reasoned order, if at all any final permission is to be granted to the unofficial respondent No.6, and in the meantime not to permit him to draw water, much less to raise seed and cultivate.

Accordingly, this Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
