HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION Nos.8718 and 8722 of 2010 COMMON ORDER:

Heard Sri Kondaparthi Srinivasa, counsel holding for Sri Nagesh Bheemapaka, learned counsel for the petitioners. The petitioners pray for Mandamus declaring the order of 3rd respondent dated 18.03.2010, whereunder sanction for prosecution of petitioners was granted, as illegal, arbitrary and unconstitutional. Learned counsel appearing for petitioners submits that the petitioners have retired from service and they have filed quash petitions under Section 482 of Cr.P.C. assailing the FIR lodged, pursuant to order, dated 18-03-2010. According to his information, though the quash petitions were disposed of, police have referred the case as 'no case was made out'.

From the above submission, it is clear that for all purposes the sanction granted to take prosecution against the petitioners has otherwise become unnecessary with the report filed by the police. By placing the above statement on record, the writ petitions are dismissed. No order as to costs.
