THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.12934 of 2015 ORDER:

This Criminal Petition is filed by the petitioner-accused No.4 under Sections 437 & 439 Cr.P.C. seeking to grant bail to him in Crime No.1143 of 2015 on the file of P.S. Banjara Hills, Hyderabad, registered for the offence punishable under Sections 419, 363 and 395 IPC.

Heard and perused the material available on record. It is alleged that the petitioner along with A1, A2 and A3 has pretended as police officials and stopped the auto of L.W.1 and took him in the auto to Shaikpet Nala and demanded to give money and forcibly took cell phone and Rs.700/- and one gold hanuman locket from L.W.2. They told L.W.2 that if he needs to be released, he has to give them an amount of Rs.5,000/-, on which L.W.2 told them that he knew a person in Mohamjahee Market and asked them to take him. Meanwhile, A3 made a phone call to A2 and A1 has sent the auto driver-L.W.1 and A2 reached there along with the petitioner-A4 on his Honda bike and A1 told them about what they did and they too said that they will come with them. All of them started from there and they made L.W.

2 to sit in between A1 and A3 on the Splendor Plus bike. While A2, A4 and A5 were riding the Honda bike of A2 and they were passing through Shalibanda, they saw a patrolling car, they stopped their bikes and left L.W.2 there and all of them fled away. Learned Public Prosecutor submitted that subsequent to the commission of offence, A1, A2 and A4 were arrested and A3 is yet to be arrested. He submitted that the petitioner went to the place of occurrence and travelled with the other accused. The petitioner was arrested on 29.10.2015 and since then he has been in prison. One more accused is yet to be arrested in this case.

Taking into consideration the gravity of the offence and the fact that the petitioner is also having knowledge about the commission of the offence, this Court is not inclined to grant bail to him at this stage.
