THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO. 2770 of 2019 ORDER :

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed for grant of anticipatory bail to the petitioner/ A.1 in C.C.No.184 of 2018 on the file of I Additional Chief Metropolitan Magistrate at Nampally, Hyderabad.

Heard the learned counsel for the petitioner/ A.1, the learned Additional Public Prosecutor representing the respondent-State and perused the record.

Learned counsel for the petitioner/ A.1 submits that the petitioner is not aware of the case filed against her and she came to know only when the police called her and explained it and after knowing the said fact, the petitioner, with the advise of her counsel, immediately approached the Court vide Crl.M.P.No.2480 of 2017 for extension of time to furnish sureties, but the same was dismissed on 11.08.2017 due to delay in filing the petition. As the petitioner has no other option, she filed this petition seeking anticipatory bail. 4.

The learned Additional Public Prosecutor opposed to grant bail to the petitioner and contends that the charge sheet has already been submitted and because of the non-appearance of the petitioner before the Court concerned, NBW has already been issued against her and pending NBW, the present petition has been filed with a malafide intention. 5.

In view of the dismissal of the earlier petition and in view of the fact that the charge sheet has already been submitted and NBW has already been issued against the petitioner/ A.1, this Court is not inclined to grant anticipatory bail to the petitioner.
