Heard.
The petitioner's grievance against unlawful interference of his land admeasuring Ac.8-08 cents in Sy.No.95 situated at Kovvuru Village, Kakinada Rural Mandal, East Godavari District, was already the subject matter of his earlier writ petition i.e., W.P.No.15636 of 2008. This Court has already disposed of the said writ petition on 22-07-2008 with a direction to the respondents not to interfere with the possession of the petitioner in respect of the land in question in any manner whatsoever without following the due process of law.
The District Collector, Kakinada, East Godavari District, the Revenue Divisional Officer, Kakinada, East Godavari District and the Mandal Revenue Officer, Kakinada Rural Mandal, East Godavari District, are parties to the said order. While the said order is subsisting, the present writ petition is filed against the very same respondents making similar allegation that there is an attempt to dispossess the petitioner.
I do not see any reason for the petitioner once again approaching this Court by way of present writ petition when this court has already protected him under the order aforesaid. The relief, to that extent, therefore cannot be granted in the present writ petition.
Secondly, to the extent of relief sought for by the petitioner for grant of pattadar pass books etc., is concerned, the petitioner has to make appropriate application under Form 6-A of A.P.Rights in Land and Pattadar Pass Books Act, 1971 read with Rule 18 of A.P.Rights in Land and Pattadar Pass Books Rules, 1989 seeking issuance of pattadar pass books and title deeds, but there is nothing on record to show that the petitioner has made such an application. Hence, the petitioner is at liberty to make an application under form 6-A of A.P.Rights in Land and Pattadar Pass Books Act, 1971 read with
Rule 18 of A.P.Rights in Land and Pattadar Pass Books Rules, 1989 and seek appropriate orders from the competent authority. Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
