THE HON'BLE SRI JUSTICE K.C. BHANU AND THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI SPL.A.No.20 of 2000 JUDGMENT: (per Hon'ble Sri Justice K.C. Bhanu) It is stated by both the counsel that the issue involved in this appeal is squarely covered by the Division Bench judgment of this Court dated 21.09.2005 in Special Appeal No.41 of 1994 and batch reported in 145 STC 399.

Following the said judgment and for the reasons mentioned therein, the appellant herein is not entitled to any relief to the extent of bottles. However, it is entitled to the relief in respect of the cartons. Accordingly, the Appeal is allowed in part in terms of the Division Bench judgment of this court dated 21.09.2005 in Spl.A.No.41 of 1994 and batch. Registry is directed to enclose a copy of the said judgment. There shall be no order as to costs.

Miscellaneous petitions, if any pending in this appeal, shall also stand dismissed.
