THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.34766 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India to declare the action of respondent Nos.2 to 5 in opening rowdy sheet in the name of the petitioner in Hanamkonda Police Station in the year 2013 and calling him frequently to the police station as illegal and arbitrary and consequently, to direct respondent Nos.2 to 5 to remove the rowdy sheet opened in the name of the petitioner from Hanamkonda Police Station.

Heard and perused the material available on record. 3.

The main grievance of the petitioner is that respondent Nos.2 to 5 opened a rowdy sheet against him in Hanamkonda Police Station in the year 2013 and under the guise of opening the rowdy sheet, they are frequently calling him to the police station and hence, prays to give a direction to them to remove the rowdy sheet opened against him.

Respondent No.4 filed counter wherein it is stated that the petitioner is involved in several criminal cases and in order to curtail the unlawful activities of the petitioner in the vicinity of Hanamkonda Police Station, a rowdy sheet was opened against him on 16.7.1989 and later, the same was closed on 15.9.2006 and as he did not change his attitude, again, the same rowdy sheet was reopened on 25.3.2013 and the same is being continued and renewed from time to time and it was extended till 31.12.2016;

that in view of the public interest, the rowdy sheet against the petitioner is being continued and renewed from time to time and hence, prays to dismiss the writ petition.

Considering the facts and circumstances of the case, this Court is not inclined to grant the relief sought for and the writ petition is liable to be dismissed.

Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
