THE HON'BLE DR JUSTICE SHAMEEM AKTHER SECOND APPEAL Nos. 1123 of 1999 & 1125 of 1999 COMMON JUDGMENT:

Heard the learned counsel for the appellants. Perused the record. There is no representation on behalf of the respondent though the matters are posted under the caption 'for orders'.

Learned counsel for the appellants does not want to go into the merits of the appeal. A perusal of the record shows that both the Courts below recorded concurrent findings with regard to building permissions obtained in respect of the subject property. No variation is warranted in these appeals. In the circumstances of the case, no substantial question of law arises for adjudication in these Second Appeals.

Learned counsel for the appellants submits that the appellants herein filed application before the GHMC for regularization of building vide Application No.2000085819, dated 24.01.2016, and he requests that the application be disposed of by the GHMC in accordance with law. In view of the submissions, the respondent/GHMC shall dispose of the application referred above in accordance with law, procedure and rules governing it. With the above direction, these appeals are dismissed.

No costs. Miscellaneous Petitions pending, if any, in the Second Appeal shall stand closed.
