THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.24147 of 2002 ORDER:

This writ petition is filed seeking the following relief: " to issue a writ of Mandamus or any other appropriate writ declaring that the order in C.M.A.No.204 of 2000 dated 21.10.2002, on the file of the Chief Judge, City Civil Court, Hyderabad confirming the order of the 1st respondent in proceedings No.B1/ E10/ F3/ MD/ 2000 dated 13.7.2000 directing eviction of the petitioner from Quarter No.B-10/ F3, Madannapet colony, Hyderabad is arbitrary and illegal and direct the respondents not to interfere with the possession and enjoyment of the petitioner over said quarter."

When the matter is taken up for hearing, learned counsel for the petitioner submitted that the petitioner was allotted Quarter No.B-10/ F.3 Maddannapet colony in the month of July, 1997 and the authorities have passed orders evicting the petitioner from the quarter. Learned counsel for the petitioner further submitted that by virtue of interim orders, the petitioner was continued in the quarter. It is needless to say that if the petitioner is entitled for allotment of the quarter, his case may be considered as per rules and, if not, after following the procedure, the petitioner may be evicted from the quarter.

With the above observations, the Writ Petition is disposed of. No order as to costs.
