HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO I.A.Nos.1 of 2018 in/and Criminal Petition Nos.2985 and 6770 of 2016 COMMON ORDER:

The petitioner is the accused in both the crimes 63 and 99 of 2016 of Police Station, Sarpavaram registered for the offences punishable under sections 493, 417 and 376IPC in Cr.No.63 of 2016 and for the offences punishable under Sections 468 and 471 IPC in Cr.No.99 of 2016 and seeking for quashing of the respective First Information Reports in the two Criminal Petitions.

The 2nd respondent is the defacto-complainant in both the petitions and also the so called victim. It is during the pendency of the quash petitions, the defacto-complainant come forward with her affidavit to compound the offences saying the reports were given under certain circumstances, thereby sought for permission of compounding the offence. On perusal of record shows earlier this Court rejected the permission for compounding. In fact, the victim was major and admitted even from the report, leave about the delay of about nearly six months in reporting occurrence, after the alleged promise to marry in having sexual intercourse by force from the very report and subsequently voluntarily participated. The victim herself says to purchase peace but for her own life without concerning with the accused in her future prospects, she wants to compromise.

Taking into consideration of these facts, I.A.Nos.1 of 2018 are allowed. Consequently both the Criminal Petitions are allowed by quashing the proceedings in both the crimes 63 and 99 of 2016 of Police Station, Sarpavaram. The accused is acquitted. His bail bonds shall stand cancelled. Pending miscellaneous petitions, shall stand closed.
