HONOURABLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION NO. 6228 OF 2007 O R D E R :

This writ petition is filed by the petitioner to direct the first respondent to sanction the pension and other benefits to the petitioner in accordance with Swatantrata Sainik Samman Penshion Scheme, 1980 and to declare the action of the respondents in not sanctioning the said pension to the petitioner as illegal, arbitrary, violative of Article 14, 21 of the Constitution of India and against the Swatantrata Sainik Samman Penshion Scheme 1980 and to pass such other suitable orders as this Court may deem fit and proper in the circumstances of the case.

2. Heard the learned counsel for the petitioner and the learned Assistant Solicitor General representing the first respondent, learned Government Pleader for the second and third respondents.

3. After hearing both sides and on perusing the record, it appears that the petitioner died, nothing survives in this writ petition for adjudication, and moreover the legal heir under the aforesaid scheme, the wife, is also not surviving and she too died.

4. In view of the above, the writ petition is dismissed. No costs.

5. As a sequel, miscellaneous petitions if any pending in this writ petition shall stand closed.
