HON'BLE SRI JUSTICE T. SUNIL CHOWDARY Criminal Petition No.2223 of 2010 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioners/ accused 2 and 3 in C.C.No.326 of 2009 on the file of V Additional Junior Civil Judge, Guntur, arising out of Crime No.204 of 2007 of Arundelpet Law and Order Police Station, for the offences punishable under Sections 498-A, 342, 324 read with Section 34 IPC.

When the matter was taken up for hearing on 16-02-2016, there was no representation for the petitioners and the matter was directed to be listed to 19-02-2016 under the caption "for dismissal". Even today also, when the matter is taken up for hearing, there is no representation for the petitioners even though the matter is listed under the caption "for dismissal". It seems that the petitioners are not interested in prosecuting the matter effectively and this Court is left with no other option except to dismiss for petition for default.

Accordingly, the Criminal Petition is dismissed for nonprosecution. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
