HONOURABLE SRI JUSTICE P.NAVEEN RAO Date: 19.09.2017 Between:
Bandi Kondaiah, S/o late Bandi Veeraiah, Aged 63 years, Occu: Agriculture, Lakshmi Nivas, Laxmipur (V), Kothapalli (M), Karimnagar District and another. .....Petitioners and State of Telangana (Revenue Department), rep.by its Principal Secretary, Secretariat, Hyderabad and others. .....Respondents The Court made the following:
HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:
Petitioners claim that though they are the owners and in possession of land to an extent of Ac.0.27 guntas each in Sy.No.29 of Laxmipur Village, Kothapalli Mandal, Karimnagar district, erroneously their names were deleted from the revenue records as pattadars and in spite of submitting representations to the Tahsildar and the Revenue Divisional Officer, so far their names are not restored. Hence, this writ petition.
2.
As could be seen from the averments in the affidavit filed in support of the writ petition, names of the petitioners were deleted from the revenue records as pattadars. If such deletion was erroneously made by the Tahsildar, petitioners have a remedy in the form of appeal to the Revenue Divisional Officer. Apparently, so far no such appeal is filed. Therefore, it cannot be said that the Revenue Divisional Officer erred in not acting on the representations made by the petitioners. Granting liberty to the petitioners to file an appeal against deletion of their names from the revenue records, writ petition is disposed of. As and when such appeal is filed, after following due process, the Revenue Divisional Officer shall pass appropriate orders as warranted by law within a period of two weeks from the date of receipt of such appeal.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ___________________________ JUSTICE P.NAVEEN RAO Date: 19.09.2017 kkm
