THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.10634 of 2019 ORDER:

The present Writ Petition is filed seeking a writ of mandamus declaring the action of the respondents in detaining the petitioner's vehicle bearing registration No.AP 29 BV 3087 as arbitrary and illegal and for a consequential direction to the respondents to release petitioner's vehicle.

The case of the petitioner is that his vehicle was seized on 12.05.2019 on account of testing positive in the Alcohol Breath Analyzer test and the petitioner was advised to attend the counselling centre on 13.05.2019 at Madhapur Traffic Police Station. The petitioner also attended for the same. The further case of the petitioner is that his vehicle was illegally stationed at the office of the third respondent since 13.05.2019 and the vehicle is being exposed to sun and rain. When the petitioner approached the third respondent with all the relevant and supporting documents for release of his vehicle, the respondents insisted the petitioner to obtain orders from this Court. Aggrieved by the same, the present Writ Petition is filed. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader appearing for the respondents.

Learned Assistant Government Pleader submits that if the petitioner produces all the relevant original documents relating

to the subject vehicle and also if the petitioner gives an undertaking that he will appear before the concerned Court as and when required, his vehicle will be released. In view of the facts and circumstances of the case, this Writ Petition is disposed of directing the third respondent to release the subject vehicle to the petitioner on his producing all the relevant original documents pertaining to the vehicle and also on his furnishing an undertaking that he will appear before the concerned Court as and when required on issuing notice.
