THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA CRIMINAL PETITION No.6817 OF 2016 ORDER:

The petitioner, who is the sole accused in Crime No.15 of 2013 of Police Station Sarangapur, Karimnagar District, registered for the offence punishable under Section 34 (a) of A.P. Excise Act, is making a request, under Section 482 of the Code of Criminal Procedure, 1973, to return his passport deposited with the I Additional Judicial Magistrate of First Class, Jagtial, as per order, dated 04.02.2013, in Cr.M.P.No.61 of 2013 in the aforesaid crime, by setting aside the order, dated 12.04.2016, passed in Crl.M.P.No.325 of 2016 in Cr.M.P.No.61 of 2013 on the file of II Additional Sessions Judge, Karimnagar at Jagtial, whereby and whereunder, the learned Sessions Judge has dismissed the petition filed by the petitioner seeking to relax the condition imposed viz., to deposit his passport, in the order, dated 04.02.2013.

2. Learned counsel for the petitioner makes it clear that the petitioner has not moved any such application before the learned I Additional Judicial Magistrate of First Class, Jagtial.

3. Without availing the remedy, at the first instance, before the primary Court, the petitioner has chosen this forum.

4. Therefore, the present Criminal Petition is disposed of directing the petitioner to approach the learned I Additional Judicial Magistrate of First Class, Jagtial, for the relief sought herein.

5. Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
