HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.407 of 2014 ORDER:

This petition is filed to withdraw Arbitration O.P.No.1095 of 2012 from the file of XIII Additional District Judge, Gajuwaka, and transfer the same to II Additional District Judge, Visakhapatnam, to be tried along with Arbitration O.P.No.1458 of 2011.

2. Petitioner herein is petitioner in both the Arbitration O.Ps. and according to affidavit of petitioner, as both the Arbitration O.Ps. arise out of same arbitration award, both the cases have to be tried by one Court to avoid conflicting decisions.

3. Heard arguments.

4. First respondent has no objection for transfer of Arbitration O.P.No.1095 of 2012.

5. Considering the reasons stated in the affidavit, Arbitration O.P.No.1095 of 2012 is withdrawn from XIII Additional District Judge, Gajuwaka and transferred to II Additional District Judge, Visakhapatnam, to be tried along with Arbitration O.P.No.1458 of 2011.

6. Accordingly, transfer C.M.P. is ordered. No costs.
