THE HON'BLE SRI JUSTICE R. KANTHA RAO WRIT PETITION No.6016 OF 2015 DATED: 24.03.2015 Between:

Smt. Aruna Devi .. Petitioner And The State of Andhra Pradesh, Rep. by its Principal Secretary, Consumer Affairs, Food & Civil Supplies Department, and others.

.. Respondents THE HON'BLE SRI JUSTICE R. KANTHA RAO WRIT PETITION No.6016 of 2015 ORDER:

Questioning the action of the 3rd respondent-Revenue Divisional Officer in suspending the fair price shop authorization of the petitioner, vide proceedings in Rc.(M).No.317/2015 dated 23.02.2015, the petitioner filed the present writ petition. Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies (A.P.).

Perusal of the impugned proceedings shows that the authorization held by the petitioner in respect of fair price shop No.16 of Devanakonda Village was

suspended on the ground that she is not residing in Devanakonda village and she is residing in Kurnool along with her husband after her getting married. Learned counsel for the petitioner submits that though the petitioner got married, she is residing in Devanakonda village only and without considering the same, the 3rd respondent suspended the authorization of the petitioner, which is unjustified.

In the facts and circumstances of the case, since the authorization of the petitioner is suspended pending enquiry, the writ petition is disposed of directing the 3rd respondent to complete the enquiry and pass final orders within a period of eight weeks from the date of receipt of a copy of this order. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
