CVNR, J & TR, J CRP.No.235 of 2017 Dt: 25.01.2017 Order: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Civil Revision Petition arises out of award, dated 29.04.2016, in Arbitration Claim Petition No.254 of 2015 on the file of the Deputy Registrar of Chits/Arbitrator (District Registrar), Krishna District at Vijayawada.

At the hearing, Mr.M.V.Venu, learned Counsel for the petitioner, has not disputed the fact that his client has a remedy of instituting proceedings under Section 34 of the Arbitration and Conciliation Act, 1996 (for short 'the Act') for setting aside the arbitration award, which is assailed in this Civil Revision Petition. In view of this admitted legal position, this Civil Revision Petition is not maintainable and the same is, accordingly, dismissed as such without adjudicating on merits and with liberty to the petitioner to avail the remedy under Section 34 of the Act. As a sequel to dismissal of the Civil Revision Petition, CRPMP.No.309 of 2017, filed by the petitioner for interim relief, is disposed of as infructuous.
