THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.4763 of 2015 ORDER:
The criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings in FIR.No.99 of 2015 of Kukatpally Police Station, Cyberabad, Ranga Reddy District.
Heard the learned counsel appearing for the petitioners and the learned Additional Public Prosecutor, representing the State. Basing on the complaint lodged by the 2nd respondent/complainant, which was forwarded by the learned IX Metropolitan Magistrate, Cyberabad, Kukatpally, under Section 156 (3) Cr.P.C., the police registered a case against the petitioners herein for the offences punishable under Sections 498-A and 406 read with 34 IPC and Sections 3 and 4 of the Dowry Prohibition Act. The allegations in the complaint, prima facie, reveal the commission of offences punishable Sections 498-A and 406 read with 34 IPC and Sections 3 and 4 of the Dowry Prohibition Act by the petitioners herein. This is a matter which requires investigation by the police, and there are no valid grounds to quash the First Information Report.
In the facts and circumstances of the case and as requested by the learned counsel for the petitioners, the Criminal Petition is disposed of, directing the investigating agency to proceed with the investigation, however, without arresting the petitioners 2 to 7 in FIR.No.99 of 2015 of Kukatpally Police Station, Cyberabad, Ranga Reddy District.
Pending miscellaneous applications, if any, shall stand closed in consequence.
