Heard.

2. The building permission application submitted by the petitioners for construction of commercial building at H.Nos.4-51 and 4-52, IEEZA road, is rejected vide proceedings dated 17.06.2018.

3. The primary contention urged is that in the said proceedings no reason is assigned as to why the building permission application is rejected.

4. On instructions, the learned Standing Counsel fairly submits that due to some technical problem, the reasons could not be reflected in the order, but the petitioners were orally informed the reasons for rejection.

5. Apparently, there is no indication of reasons for rejection of the application of the petitioners. Since the rejection of building permission would have evil consequences to the petitioners, they are entitled to know the reasons for rejection of their application.

6. Therefore, the impugned order dated 17.06.2018 is set aside and the matter is remitted to the 2nd respondent-The Ieeza Municipality with a direction to consider the application of the petitioners afresh and pass appropriate orders by assigning due reasons.

7. Accordingly, the Writ Petition is allowed. Miscellaneous Petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ___________________ P.NAVEEN RAO, J 10th June, 2019.
