THE HON'BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.1937 of 2015 ORDER :
By order dated 26.06.2015 this Court directed both parties to maintain status-quo obtaining as on date for two weeks. In the main writ petition, the prayer sought was against the notice dated 18.06.2015. By the said notice auction was proposed for grant of lease of
temple lands. Petitioners prayed for setting aside the said auction notice to an extent of Ac.1.27 cents in Sy.No.414/1 of Lingareddypalem Village, Koduru Mandal, Krishna District. Thus, the order of status-quo granted relates to conducting of auction.
2. The said interim order was extended until further orders. Though petitioners also filed W.P.M.P.Nos.24794 & 27495 of 2015 in W.P.No.19179 of 2015, no interim order as sought for in these petitions was granted.
3. Learned counsel for the petitioners fairly submit that auction was not conducted after the interim orders passed by this Court. The grievance of the petitioners as contended by learned counsel for the petitioners is that the respondents are interfering with the peaceful possession and enjoyment of land by the petitioners. Since the order passed by this Court does not concern continuous enjoyment of the subject property by the petitioners, it cannot be said that the respondents have violated and committed contempt of the orders of this Court.
4. Hence, I see no reason to proceed with the contempt proceedings against the respondents.
5. Accordingly, the Contempt case is closed. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this contempt case shall stand closed.
