Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.
The petitioner was appointed as a Fair Price Shop Dealer in respect of Shop No.31, Kallipedu village, Naidupet Mandal, Nellore District. The authorization of the petitioner is valid up to 31.03.2016. While so, on the basis of the complaint of the villagers, the 3rd respondent issued an order of suspension on 08.06.2015 suspending the authorization of the petitioner without mentioning the period of suspension.
However, the petitioner preferred an appeal on 15.06.2015 to the 2nd respondent against the said order. Simultaneously, he filed the present writ petition challenging the order of suspension dated 08.06.2015.
In view of the allegations mentioned in the impugned order of suspension, this Court is not inclined to entertain the present writ petition. However, the learned counsel for the petitioner submitted that no show cause notice was issued till today. In that view of the matter, the 3rd respondent is directed to issue show cause notice in respect of the allegations levelled against the petitioner, invite an explanation from the petitioner within a period of 15 days from the date of receipt of that show cause notice, conduct an enquiry and thereafter pass final orders therein within a period of 30 days.
With the above observations and directions, this writ petition is disposed of. However, in view of the disposal of the present writ petition, it is observed that the appeal preferred by the petitioner before
the 2nd respondent on 15.06.2015 becomes infructuous. There shall be no order as to costs. As a sequel, the miscellaneous petitions, if any pending in this writ petition, shall stand closed. __________________________ A.RAMALINGESWARA RAO, J Date: 23.06.2015 siva
