Heard learned counsel for the petitioner, learned Government Pleader for Municipal Administration for respondent No.1 and also Sri Sampath Prabhakar Reddy, learned Standing Counsel respondent Nos.2 & 3 and perused the prayer in the writ petition with the supporting affidavit.
It is the averment that the respondents are trying to demolish existing constructions pending finalization of the BRS application dated 31.01.2016 pending with them. It is the submission of the learned Standing Counsel that the petitioner under the guise of the same making unauthorized construction of the floors and the authorities are going to take appropriate action. Having regard to the above, there is nothing to keep the writ petition pending, but for disposal to consider the BRS application dated 31.01.
2016 of the petitioner pending with the respondents on own merits and pass appropriate orders and communicate the same within one week from the date of receipt of this order subject to the compliance with the statutory requirements, if any, and meantime the petitioner shall not make any further construction and the respondents shall not demolish except through due process of law by giving any statutory notice if at all required for any deviation. With the above observations, this Writ Petition is disposed of. Consequently, miscellaneous petitions, if any shall stand closed. No costs.
