This writ petition is filed for declaring the notification dated 24.09.2007 vide letter No.A1/311/2007 issued by the 1st respondent as illegal, arbitrary and violative of Articles 16 and 21 of the Constitution of India.
The brief facts of the case are that the petitioner has applied for the post of Anganwadi worker in pursuance of the notification issued by the 1st respondent in the month of October, 2006. The notification shows that there is only one vacancy pertaining to Anganwadi worker. The respondents have issued hall ticket No.214138 to the petitioner for the purpose of written examination to be held on 19.11.2006. The petitioner had appeared for the written examination and also oral examination, which were conducted on 03.02.2007 and 05.02.2007 respectively. It is the case of the petitioner that as she was the only candidate applied for the post of Anganwadi worker in pursuance of the notification issued by the respondents, the respondents have cancelled the notification and contemplated to issue a fresh notification.
Hence, the petitioner has filed this writ petition and sought for interim orders. On 06.10.2007, this Court granted interim order in W.P.M.P.No.27539 of 2007 directing the respondents to reconsider the case of the petitioner for the post of Anganwadi worker in pursuance of the earlier notification issued in October, 2006, and pass appropriate orders, within a period of two weeks from the date of receipt of a copy of this order. Till such time, all the proceedings in pursuance of the impugned notification dated 24.09.
insofar as the post of Anganwadi worker of Pedamangyathanda, Velikatta Village, Torrur Mandal of Warangal District shall stand stayed. In pursuance of the interim order passed by this Court on 06.10.2007, the District Collector has issued an order directing the respondents to appoint the petitioner as Anganwadi worker. It is submitted by the learned Government Pleader for Women Development and Child Welfare that the petitioner was appointed as Anganwadi worker on 27.11.2007 and she has been working since then and therefore, no further orders are required in this writ petition. Learned counsel for the respondents does not dispute the same. In view of the foregoing reasons, since the petitioner has already been appointed as Anganwadi worker on 27.11.2007 and she has been continuing in service, no further orders are required in this writ petition. Accordingly, this writ petition is dismissed. There shall be no order as to costs.
