HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.12063 OF 2002 ORDER:

1. When this matter is taken up for hearing, it is reported by the learned Counsel for the petitioner that this petition was filed when the services of the petitioner were disengaged vide proceedings dated 19.6.2002 and this Hon'ble Court vide order dated 5.7.2002 was pleased to grant interim suspension of the proceedings dated 19.6.2002, and by virtue of the said interlocutory order, the petitioner is being continued even as on today.

2. From the material on record, it is obvious that at the time of issuing the proceedings impugned, no notice was given to the petitioner and on that ground, the proceedings impugned are liable to be set aside.

3. Accordingly, the Writ Petition is allowed. However, if the respondents want to take any action against the petitioner, they are at liberty to do so only after following the procedure. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
