HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL REVISION CASE No.764 of 2018 ORDER:
Heard the learned counsel for the petitioner. This Criminal Revision Case is disposed of at the admission stage as this Court finds no reason to order notice to the respondents. This Criminal Revision Case is filed by the petitioner/appellant/accused aggrieved by the docket order dated 6-2-2018 dismissing Crl.M.P.No.3296 of 2017.
It is to be noted that as per the order dated 8th January, 2018, the learned Metropolitan Sessions Judge, Hyderabad, granted suspension of sentence on the condition of petitioner depositing half of the cheque amount by 6th February, 2018. When the matter is posted to 6th February, 2018 as the petitioner was absent, as there was no representation, the petition was dismissed. Aggrieved by the same, the present Criminal Revision Case is filed. Sri A.Venkateswarlu, learned counsel for the petitioner would submit that due to unavoidable circumstances, he could not be present on that day and he is ready to deposit the amount and time may be granted to him till 19-3-2018.
Learned counsel would submit that the petitioner is lodged in jail pursuant to the execution of N.B.W.
Considering the above submission of learned counsel, this Criminal Revision Case is allowed and the impugned order is set aside and suspension of sentence of imprisonment and bail are
granted to the petitioner, pending the Criminal Revision Case, on his executing personal bond for Rs.10,000/- (Rupees ten thousand only) with one surety for a likesum to the satisfaction of the lower appellate court and also on further condition of his depositing half of the cheque amount on or before 19th March, 2018. As a sequel, miscellaneous applications pending if any, shall stand closed.
