THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.18850 of 2015 AND CONTEMPT CASE No.1350 of 2015 COMMON ORDER:
The petitioner is HT consumer of electricity. It was due of an amount of Rs.4,17,53,538/-. The fifth respondent granted ten monthly instalments of Rs.41,75,154/- each for payment of the said amount, by his order dated 09.06.2015. So far, the petitioner paid four instalments as per the said order and the fifth instalment is due on 10.09.2015. Due to several difficulties, the petitioner is unable to pay the instalments on due dates and the petitioner has been approaching this Court whenever difficulty arose in payment of the instalments.

When the writ petition came up for consideration before this Court, this Court directed the petitioner to file an affidavit indicating the instalments in which the balance amount would be paid, since six instalments are yet to be paid by the petitioner. The amount outstanding is Rs.2,50,50,924/- and the petitioner now filed an affidavit stating that the petitioner would pay the said amount in ten monthly instalments instead of six instalments granted by the fifth respondent, by his order dated 09.06.2015.

Keeping in view of the financial difficulties, in which the petitioner is placed, this Court thinks it proper to allow the petitioner to pay the balance amount of Rs.2,50,50,924/- in ten equal monthly instalments of Rs.25,05,095/- commencing from 30.09.2015. If any particular instalment is not paid, it is open to the respondents to disconnect the service connection without any further notice. The learned Standing Counsel for the respondents accepts the affidavit
filed by the petitioner for payment of the balance amount in ten monthly instalments.
4. Accordingly, the writ petition is disposed of in terms of the consensus arrived at by the petitioner as well as by the respondents. In view of the same, the contempt case is also closed.
