Heard learned counsel for the petitioners and learned Government Pleader for Land Acquisition.

Petitioner No.3 claims that his father was the absolute owner and in possession of land to an extent of Ac.0.04 guntas in Survey No.7/3 of Yerravelli Village and his name was also mutated in the revenue records. He submits that this piece of land is also part of the acquisition by the State Government for development of Irrigation Project called 'Mallanna Sagar Reservoir'. When petitioners came to know that the competent authority was negotiating with unofficial respondents 5 and 6 for determination of compensation and payment thereof, petitioners filed O.S.No.139 of 2015 in the Court of Junior Civil Judge, Siddipet, and the same is pending. Petitioners objected the payment of compensation to unofficial respondents 5 and 6 as dispute is pending in civil Court. This Writ Petition is filed alleging that respondents 3 and 4 are trying to disburse the compensation amount to unofficial respondents 5 and 6 on the above extent of land and they also seek a direction to respondents 3 and 4 not to disburse the compensation amount till the civil dispute is decided.

The Revenue Divisional Officer, Gajwel, furnished the written instructions dated 03.06.2019 to learned Government Pleader and the said written instructions would disclose that Smt. Myraboina Laxmi, W/o. Komraiah, was paid compensation

against the above extent of land vide proceedings dated 24.09.2016.

Hence, it appears that the compensation to the extent, referred to above, was already paid and no claims are pending before the competent authority.

Thus, leaving it open to the petitioners to prosecute the pending litigation and work out their remedies as available in law on the issue of ownership and payment of compensation, the Writ Petition is dismissed. Pending miscellaneous petitions, if any, shall stand closed.
