THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1896 OF 2015 ORDER:

This Criminal Revision Case is filed by the petitioneraccused challenging the order of the Judicial First Class Magistrate-Special Mobile Court, Kurnool dated 25.07.2015 whereby the learned Magistrate dismissed Crl.M.P.No.592 of 2015 in C.C.No.355 of 2014 filed by the petitioner to discharge him from the said case.

After arguing for some time, when this Court is not inclined to interfere with the impugned order, the learned counsel for the petitioner confined his argument to the extent of dispensing with the presence of the petitioner before the trial Court. Being the offence alleged against the petitioner is under Section 138 of Negotiable Instruments Act, the question of his identity before the trial Court does not arise.

In the circumstances, the presence of the petitioner before the trial Court is dispensed with except on the dates so specifically the trial Court insists for his appearance. The petitioner is directed to be represented by a counsel on all hearing dates.

The Criminal Revision Case is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
