ORDER:

This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused in Crime No.11 of 2026 of Chilkalguda Police Station, Hyderabad, registered for the offences punishable under Sections 68(a), 75, 77, 78 of the Bharatiya Nyaya Sanhita, 2023 (for short 'BNS').

The brief facts of the case are that, on 06.01.2026, the de-facto complainant lodged a report before the police

stating that she is working in INDIS Company and the petitioner called her on phone and informed her that two persons are coming for training for getting IT Job, due to which requested her to come his house for taking training along with them and inturn believing his words she resigned her job in the month of January 2025 and went to her brother-in-law's house in the month of February, 2025 for taking training and she further stated that from the month of February to April the said Umakanth behaved pleasantly with her and thereafter from the month of May to November 2025 he tortured her by getting nude photos without knowledge of her by showing the same and blackmailing her and harassed her with physical and mentally, due to which she tried to commit suicide by taking sleeping pills, even though he did not change and also he abused her and bet her with leg and informed her to listen him. Hence, the complainant requested to take necessary action. Based on the said complaint, the police registered a case against the petitioner for the aforementioned offences.

Heard Sri Koppula Gopal, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor for respondent-State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the said allegations. It is further submitted that the petitioner is in jail from 06.03.2026 and the material part of the investigation is already completed. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Addl. Public Prosecutor opposing the petition stating that the alleged offences are heinous in nature and the material part of the investigation is not yet completed. Therefore, he prayed the Court to dismiss the petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner is in jail from 06.03.2026, who is arrayed as accused and as seen

from the record LW1 to LW18 were examined.

Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner/accused, subject to the following conditions.

i.

The petitioner/accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned X Additional Chief Judicial Magistrate at Secunderabad.

ii.

The petitioner/accused shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner/accused shall abide by the conditions stipulated in

Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
