HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL REVISION CASE No.3340 OF 2015 ORDER:

Heard the learned counsel for the revision petitioner and the learned Public Prosecutor for the respondent.

2. The present Criminal Revision Case is filed under Sections 397 and 401 of Cr.P.C., by the petitioner, aggrieved by the order, dated 30.11.2015 passed in Crl.M.P.No.604 of 2015 in C.C.No.174 of 2015 by the Principal Judicial Magistrate of First Class, Mancherial, wherein and whereunder, an application filed by the petitioner seeking release of a vehicle i.e., the lorry bearing No.AP 29T 2106 belonging to the petitioner was dismissed.

2. Learned Public Prosecutor placed on record the copy of the judgment in C.C.No.174 of 2015 wherein the trial Court convicted the accused by its judgment, dated 15.12.2015, and ordered confiscation of the vehicle.

3. Learned counsel for the petitioner submits that the petitioner is a subsequent purchaser of the vehicle and he is not made a party to the proceedings. He submits that he is not aware about the proceedings before the trial Court.

4. Having regard to the circumstances stated above, the petitioner is at liberty to prefer an appeal against the order of confiscation, in which event, the same shall be dealt with in accordance with law.

5. Subject to the above direction, the Criminal Revision Case is disposed of.
