THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.14586 of 2017 ORDER :
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: " to issue any appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent in not disposing the case in File NO.B/ 858/ 2002 dated 11-8-2010, in pursuance of the remand orders in CMA No.110/ 2010 and CMA NO.154/ 2010, dated 03-06-2013, is illegal arbitrary, violative of articles 14, 21 and 300-A of the Constitution of India, besides violative of Principles of Natural Justice and consequently direct the 2nd respondent to forthwith dispose of the case No. in File NO.B/ 858/ 2002 dated 11-8-2010 in a time bound manner within a period of 30 days and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."
Heard learned counsel for the petitioner and learned Government Pleader for Forests appearing for respondents and perused the prayer in the writ petition with supporting affidavit and other material on record including the matter pending with the 2nd respondent- Forest Settlement Officer, by virtue of the remand order of the District and Sessions Judge, Ranga Reddy District, in CMA Nos.110 of 2010 and 154 of 2010 dated 03.06.2013. The grievance of the petitioner is that in spite of the remand order passed by the District and Sessions Judge, Ranga Reddy District, in CMA Nos.110 of 2010 and 154 of 2010 almost four years back on 03.06.2013, the 2nd respondent-Forest Settlement Officer, is not disposing of the case in File No.B/ 858/ 2002.
Having regard to the above, the 2nd respondent-Forest Settlement Officer is directed to dispose of the case in File No.B/ 858/ 2002 dated 11-8-2010, within four months from the date of receipt of copy of this order on merits. The petitioner is directed to appear before the Forest Settlement Officer on 17.07.2017 and on such other dates as may be fixed by the said Officer.
With the above direction, this Writ Petition is disposed of at the stage of admission. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
