The petition coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of Sri K VENUMADHAV, Advocate for the Petitioner, Asst. PUBLIC PROSECUTOR, for the Respondent, the Court made the following.

The petitioner, who is the sole accused, filed the present application under Sections 437 and 439 of Criminal Procedure Code 1973, seeking to grant bail to him in Crime No.239 of 2021, of Dundigal Police Station, Cyberabad District, registered for the offences punishable under Sections 498-4 and 306 LP.C and Sections 3 and 4 of the Dowry Prohibition Act. , 2.
Heard learned counsel for the petitioner and learned Assistant Public Prosecutor appearing for the respondent-State. 3.
It is submitted on behalf of the petitioner that the petitioner never harassed the deceased Gandigudem Srilath, who is his wife, at any point of time with regard to demand of dowry. The petitioner is having two minor children, whom he has to look after them. The petitioner is in custody since 10.03.2O21 and by this time, most part of the investigation is completed. Therefore, there is no chance of tampering the prosecution witnesses. The petitioner is ready to abide by any condition.

Learned Assistant Public Prosecutor opposed the bail application.

Having regard to the above, since most part of the { { investigation is already completed and the fact that the petitioner is having two minor children aged about 6 and 5 years, whom he has to look after them and also the fact that there is no allegation relating to demand of dowry by the petitioner on earlier occasions,
without advertising into the merits of the case, I am inclined to grant bail to the petitioner/ accused on certain terms and conditions.
(i) The petitioner/accused shall execute a personal bond for Rs. 1,00,000/- (Rupees One lakh only) with two sureties for a like sum each to the satisfaction of XXI Metropolitan Magistrate, Medchal, Cyberabad District.
(ii) The petitioner/ accused shall not tamper with the prosecution witnesses.
(iii) The petitioner/ accused shall co-operate with the investigating agency.
(iv) The petitioner/ accused shall not intimidate or give threat to the complainant or any of her family members during the period of trial.
(") The petitioner/ accused shall appear before the Investigating Officer on 4th Saturday of every month between 10:00 AM and 5:00 PM from July, 2O2l onwards till submission of final report and thereafter, the petitioner/ accused shall appear before the Court concerned personally on each date of hearing till conclusion of trial.
