THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.10297 of 2016 ORDER:

This Criminal Petition is filed by the petitioners, under Section 482 Cr.P.C., to quash the proceedings in C.C.No.53 of 2016 on the file of II Additional Chief Metropolitan Magistrate, Hyderabad, for an offence punishable under Section 138 of the Negotiable Instruments Act, 1881 (the Act).

Heard the learned Additional Public Prosecutor representing the State.

It is submitted by the learned counsel for the petitioners that, between the petitioners and respondent No.2, another C.C.No. 37 of 2016 is pending on the file of X Special Magistrate, Hasthinapuram, Ranga Reddy District, that the petitioners sought for quashing of C.C.No. 37 of 2016 in Crl.P.No.6502 of 2016, and this Court, by order dated 27.04.2016, disposed of the Criminal Petition dispensing with the presence of the petitioner before the Trial Court except on the dates when his presence was specifically required by the Trial Court.

Having perused the material on record, it is evident that it is not a fit case to quash the proceedings in the present C.C. However, on the submissions of the learned counsel for the petitioners, this Court feels it appropriate to direct the Court below to dispose of the C.C. itself as expeditiously as possible.

In that view of the matter, the Criminal Petition is disposed of directing the learned II Additional Chief Metropolitan Magistrate, Hyderabad, to dispose of C.C.No.53 of 2016, within a period of six

(6) months from today, without insisting the presence of petitioner No.2 - A.2 on each and every adjournment, unless the learned Magistrate feels that his presence is necessary for any specific

purpose.

Pending miscellaneous applications, if any, shall stand closed in consequence.
