This Writ Petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue an order or writ one in the nature of Writ of Madsmus, declaring the action of the respondent No.3, proposed to acquire and marked the additional land an extent of 261 Sq.Mtrs., i.e. agricultural land besides Machilipatnam road in Survey No. 925/5 (925-5C1) of Gandigunta Village, Krishna Dist., A.P., for the proposed widening Programme, without following due process of law and without considering the representation dt. 16-01-2017 of the petitioner as illegal, arbitrary and against the principles of natural justice and also violation of Articles300-A of Constitution of India and consequently direct the 3rd respondent not to dispossess from the lands and follow due process of law in acquiring said land before further acquiring."

When the matter is called, it is represented by the learned counsel for the petitioner that for redressal of grievance of the petitioner, the petitioner herein submitted a representation on 16.01.2017 to the Revenue Divisional Officer, Nuzvid, Krishna District, and a copy of the same was also communicated to the Project Director, National Highway-9, but no action has been taken on the said representation.

On the other hand, it is submitted by Sri S.S.Varma, learned Standing Counsel for National Highways, that appropriate action will be taken in accordance with law.

Recording the said submission, the Writ Petition is disposed of, directing the Revenue Divisional Officer/3rd respondent to

consider the representation, dated 16.01.2017, said to have been submitted by the petitioner and take appropriate action, in accordance with law within a period of two (02) months from the date of receipt of a copy of this order.
