THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.3987 ot 2021 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioners/A1 to 46 seeking to grant anticipatory bail in the event of their arrest in Cr.No.74 of 2021 on the file of Women Police Station-|, Warangal District, registered for the offences punishable under Sections 498-4,494,506 IPC and under Sections 3 and 4 of Dowry Prohibition Act, 2.

Heard learned counsel for the petitioners/A1 to 46, learned Assistant Public Prosecutor appearing for the respondent-State and perused the record.

lt is alleged in the complaint that the marriage of the de-facto complainant was performed with 41 on 19.04.2009, and at the time of marriage, her parents gave cash of Rs.8,00,000/- and other gold ornaments, motorcycle etc., and they blessed with two female children. Thereafter, A1 at the instigation of other accused harassed her mentally and physically by demanding additional dowry and 41 also performed second marriage with one Puja @ Vaishnavi.

Learned counsel for the petitioners/Al to ,46 would submit that thd petitioners did not commit any offence as alleged by the de-facto complainant, He would further submit that there is no specific allegation against the petitioners with any dates, events, except making sweeping allegations. He would also submit that the petitioners are not involved in any other crime prior to this occurrence and they are a law abiding citizens and ready to abide by any condition that may be imposed by this Court in I the event of their enlargement on anticipatory bail. 5.

Learned Assistant Public Prosecutor vehemently opposed to grant anticipatory bail to the petitioners.

Having regard to the facts and circumstances and since it is a matrimonial dispute, and also in view of peculiar conditions of pandemic COVID-19 prevailing in the country, without delving into the merits of the matter, I am inclined to grant anticipatory bail to the petitioners/Al to 46. 7.

The Criminal Petition is accordingly allowed and the petitioners/A1 to 46 are granted anticipatory bail subject to the following terms and conditions:

(i) The petitioners/A'1 to ,46 are directed to surrender before the Station House Officer, Women Police Station-1, Warangal District, within a period of 15 days from the date of this order and on such surrender, the said Station House Officer shall release the petitioners/A1 to 46 on bail on their executing a personal bond to the tune of Rs.25,0001 (Rupees twenty five thousand only) each with two sureties for the like sum each to his satisfaction.

(ii) On such release, the 1st petitioner/A1 shall appear before the lnvestigating Officer on 3'd Saturday of every month between 10.00 AM and 2.00 PM., from 15.07.2021 onwards, till completion of investigation or filing of the charge sheet whichever is earlier.

(iii) The petitioners/A1 to 46 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
