HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION No.4246 OF 2010 ORDER:

The proceedings under challenge in this Writ Petition is the letter of the Commissioner, A.P. Vaidya Vidhana Parishad, Hyderabad dated 31.12.2009 whereby it was decided to award out-sourcing contracts, of supporting services of all hospitals, to the fourth respondent subject to the terms and conditions mentioned therein. By the order of this Court dated 24.02.2010, the said proceedings dated 31.12.2009 were suspended.

An elaborate counter-affidavit is filed by the first respondent stating that the norms and guidelines, stipulated for selecting the fourth respondent for providing services, are legal and valid. The said interim order, however, subsists even as on date. As more than seven years have elapsed, since the impugned proceedings were suspended, I consider it appropriate to direct the first respondent to examine the mater afresh and take a considered decision on whether or not to out-source these services, and then take action in accordance with law. The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. No costs.
